PLAINTIFFS’ NOTICE OF MOTION AND
MOTION TO SET A
TIME CERTAIN BY WHICH REGISTRANTS OF THE
DEFENDANT
DOMAIN NAMES MUST RESPOND TO THE COMPLAINT
PLEASE TAKE NOTICE that on November 16, 2001 at 10 a.m., or as soon thereafter as this motion may be heard, the United States Olympic Committee, the International Olympic Committee and Salt Lake Organizing Committee for the Olympic Winter Games of 2002 (collectively, the “Olympic Plaintiffs”) will move this Court for an order requiring the 322 registrants (from 36 countries) of 891 Defendant Internet domain names to answer the allegations of the Olympic Plaintiffs’ Complaint. These domain names contain the distinct, famous and world-renowned trademarks OLYMPIC and OLYMPIAD and simulations thereof, such as misspellings and foreign equivalents.
As more fully set forth in its accompanying memorandum in support of this motion, the Olympic Plaintiffs have provided the 322 registrants of these 891 domain names with a copy of the Complaint by notifying them of this action and providing them with either a copy of the complaint or hyperlink, a specific Internet address that can be directly accessed with the “click” of a mouse, at which the Complaint could be viewed.
With this Motion, the Olympic Plaintiffs seek an order from the Court setting a time certain for the 322 registrants of the 891 domain names, all of whom have received a copy of the Complaint, to answer the Complaint or otherwise plead within thirty (30) days of this Court’s Order granting the Olympic Plaintiffs’ Motion To Set a Time Certain by Which Registrants of the Defendant Domain Names Must Respond to the Complaint for those Registrants receiving notice of the Order.
